Terms of Service

Effective Date: October 20, 2025

These Terms of Service (the “Terms“) govern your access to and use of buildtheblockconstruction.com (the “Site“) operated by Build the Block Construction (“Build the Block,” “we,” “our,” or “us“). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Project Contracts. These Terms govern website use only. Any estimate, quote, work order, or construction contract you sign with us will govern your project relationship and, in case of conflict, will prevail over these Terms.

1) Eligibility & Account Features

The Site is intended for use by individuals 18 or older. You may be able to submit forms, sign up for communications, or request consultations. You are responsible for the accuracy of information you provide. If the Site offers login‑protected areas, you are responsible for safeguarding your credentials and all activities under your account.

2) Estimates, Quotes, and Informational Content

Any prices, timelines, or scope details shown on the Site are for general informational purposes only and are not binding offers. Actual proposals depend on site conditions, materials, engineering, permitting, current availability, and other factors. We may request a site visit and additional information before providing a formal quote.

3) Acceptable Use

You agree not to:

  • Use the Site for unlawful, harmful, or abusive purposes;
  • Attempt to disrupt or compromise the Site’s security or functionality;
  • Crawl, scrape, or use automated means except as permitted by robots.txt;
  • Upload or transmit viruses, malware, or harmful code;
  • Infringe any intellectual property or privacy rights; or
  • Interfere with others’ use of the Site.
 

We may suspend or block access for violations.

4) User Content (Reviews, Testimonials, Images)

If you submit or authorize us to use reviews, testimonials, photos, or other content (“User Content“):

  • You represent you own or have rights to the content and it does not infringe the rights of others;
  • You grant us a non‑exclusive, worldwide, royalty‑free license to host, reproduce, publish, modify (e.g., resize/crop), and display the content in connection with the Site, our social channels, advertising, portfolios, and proposals, subject to our Privacy Policy;
  • We may (but are not obligated to) monitor, edit, or remove User Content at our discretion.

5) Intellectual Property

The Site, including text, graphics, logos, photos, video, and code, is owned by or licensed to Build the Block and protected by intellectual property laws. Except as permitted by law, you may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

6) Third‑Party Links and Tools

The Site may include links to third‑party websites, software, or services. We provide these for convenience only and are not responsible for their content or practices. Your use of third‑party tools is at your own risk and may be subject to their terms.

7) No Warranties; Disclaimer

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON‑INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT DEFECTS WILL BE CORRECTED.

8) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BUILD THE BLOCK AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID (IF ANY) TO USE THE SITE IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability; some of the above may not apply to you.

9) Indemnification

You agree to indemnify, defend, and hold harmless Build the Block and our owners, employees, and agents from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including your User Content.

10) Changes to the Site and Terms

We may modify or discontinue any Site feature at any time without notice. We may update these Terms by posting a revised version with a new Effective Date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

11) Governing Law; Venue

These Terms are governed by the laws of the State of Oregon, without regard to conflict‑of‑law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Jackson County, Oregon for any dispute arising from or relating to these Terms or the Site, except where applicable law provides otherwise.

12) Electronic Communications & Consent to Do Business Electronically

By using the Site or contacting us online, you consent to receive communications from us electronically (e.g., email, notices on the Site). You agree that such communications satisfy any legal requirement that communications be in writing. You also consent to electronic signatures and records in connection with Site features we may offer.

13) Termination

We may terminate or suspend your access to the Site at any time and without liability for any reason, including if we reasonably believe you have violated these Terms.

14) Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. These Terms constitute the entire agreement between you and us regarding the Site.
